Mumia is Innocent-Free Him Now!
On December 7, the Philadelphia District Attorney announced that he will not seek another death sentence for Mumia Abu-Jamal, America’s foremost class-war prisoner. The announcement by D.A. Seth Williams comes in the wake of the October 11 U.S. Supreme Court decision rejecting the D.A.’s petition to reinstate the death sentence that was overturned in 2001. This means Mumia, framed up for the killing of Philadelphia police office Daniel Faulkner in 1981, will be sentenced to life in prison without possibility of parole. While it is welcome that Mumia will no longer be under the threat of state execution, it is an abomination that this innocent man, who has already spent 30 years entombed, is condemned to a living death in prison!
The government’s drive to execute Mumia has run aground, but the vendetta of the prosecution, cops and capitalist politicians, both Democratic and Republican, against Mumia continues. There is a mountain of evidence, including Arnold Beverly’s confession that he shot and killed Faulkner, that demonstrates Mumia is an innocent man who should never have spent one day in prison. The courts have refused to consider this evidence because it exposes Mumia’s frame-up as not just some aberration of a rogue cop or a bad judge, but the result of the workings of a whole „justice“ system whose real purpose is the repression of workers, minorities and the poor on behalf of the capitalist rulers (see the July 2006 Partisan Defense Committee pamphlet, The Fight to Free Mumia Abu-Jamal-Mumia Is Innocent!).
Beginning in the late 1960s, Mumia was targeted by the police and FBI as a Black Panther leader and later as a MOVE supporter and journalist renowned for his searing exposés of cop brutality and racist oppression. The prosecution railroaded Mumia to death row in 1982, building its case on the basis of phony ballistics and other manufactured „evidence,“ a „confession“ concocted by cops and prosecutors, massive police intimidation of witnesses and racist jury rigging. His trial was overseen by „hanging judge“ Albert Sabo, who was overheard saying he would help the prosecution „fry the n—-r.“ To secure the death sentence, prosecutors pointed to political statements made by Mumia as a 16-year-old Panther.
In December 2001, federal judge William Yohn overturned Mumia’s death sentence as unconstitutional based on improper jury instructions while simultaneously upholding every aspect of the 1982 frame-up conviction. As for the Supreme Court, its 2009 denial of Mumia’s petition essentially put an end to his legal efforts to overturn his conviction on constitutional grounds.
During the decades of his unjust imprisonment, Mumia has remained unbowed, speaking out for the oppressed and the impoverished through his death row commentaries. Mumia’s cause has been an international focal point of the fight for abolition of the death penalty, which in the U.S. is the legacy of black chattel slavery and represents the pinnacle of state terror. When Mumia faced a death warrant in the summer of 1995, massive publicity about his case and worldwide protests that were endorsed by trade unions representing hundreds of thousands of workers played a crucial role in staying the executioner’s hand.
Now the state authorities hope with the latest decision that Mumia’s cause will be forgotten and that he will rot in prison hell until he dies. This must not be Mumia’s fate. As the Spartacist League and Partisan Defense Committee have always insisted, fighters for Mumia’s freedom must look to link his cause to the class struggles of the multiracial proletariat. Trade unionists, opponents of the racist death penalty and fighters for black rights must continue the fight to free Mumia from the racist dungeons of Pennsylvania and to abolish the racist death penalty.

Liebe Freundinnen und Freunde,
heute ist es exakt 30 Jahre her, dass Mumia Abu-Jamal verhaftet wurde.
Gestern und heute wurde nun offenbar, was eigentlich schon seit dem 11.
Oktober zu erwarten war, als der Oberste Gerichtshof den letzten
Berufungsantrag der Bezirksstaatsanwaltschaft von Philadelphia
zurückwies: Die tonangebenden Eliten in Justiz und Politik der USA haben
entschieden, dass Mumia Abu-Jamal nicht hingerichtet werden soll. Sie
wollen nicht alle Welt gegen sich aufbringen, wollen nicht, dass ihre
ins Wanken geratende Todesstrafenmaschinerie im In- und Ausland erneut
zum großen Thema wird. Deshalb wollen sie Mumia lieber in eine Zelle des
berüchtigten gefängnisindustriellen Komplexes verbannen und dem Tod auf
Raten aussetzen.
Es wird nun abzuwarten sein, wann Mumia aus dem Todestrakt verlegt und
unter welchen Haftbedingungen er dann wo genau eingesperrt wird. Machen
wir uns nichts vor: Sein Leben ist weiterhin in Gefahr, solange er unter
der Verfügungsgewalt seiner politischen Gegner eingesperrt bleibt. Des
wegen werden wir mit Nachdruck für seine Freiheit und erst recht für die
Abschaffung der Todesstrafe eintreten.
Heute und morgen (Gedenktag der Verabschiedung der Charta der
Menschenrechte durch die Vereinten Nationen am 10. Dezember 1948) finden
an vielen Orten weltweit Aktivitäten für Mumia und gegen die Todesstrafe
und Menschenrechtsverletzungen statt.

On Wednesday December 7, 2011 District Attorney of Philadelphia, Seth Williams, accompanied by Maureen Faulkner, announced at a press conference that he was not pursuing another hearing to reinstate the death penalty for Mumia Abu Jamal. This means that Mumia is now sentenced to life in prison without the possibility of parole. There is already talk about him now being moved into general population. Some people may celebrate this as a victory but MOVE is not under any illusions about these treacherous officials, we ain’t fooled one bit by their deviousness. We see this latest decision for exactly what it is- A devious tactic to kill Mumia in a so-called different way. Officials killed George Jackson in prison, they tried to get several different people to kill Leonard Peltier in prison and MOVE sees the same plan being laid for Mumia. This is personal for these cops and officials, they want Mumia dead just as much today as they have for the past thirty years, nothing has changed. They are furious with Mumia, with all the international support he has, with the strong consistant movement around Mumia. Cops see this as a contest, a contest they are determined to win, any way they can. That’s how sick and petty they are. They can’t stand the fact that Mumia is Black and that he sides with TRUTH over the lies of this system and they wana take him down, that’s how they determine winning. These cops and officials KNOW Mumia is innocent just like they know The MOVE 9 is innocent but they don’t care. They don’t give a damn about innocence or guilt, they don’t give a damn about Mumia’s life, they just want to win, which means killing Mumia. These cops and officials are crazed and outta control about Mumia. They can’t tell you the name of those accused/convicted of killing cops six months ago, a year ago, five years ago but they all know Mumia’s name and they hate him. They’re not like this about other people; Ted Bundy, Lee Harvey Oswald (who was convicted of killing president JFK), Mark David Chapman (who killed John Lennon) or a host of other people accused of/convicted of murder, including baby killers. Again, MOVE ain’t fooled by their trickery, we’re gonna remain vigilante over Mumia and we remain unrelenting in our fight for Mumia’s release, based on his innocence. We’re gonna expose this devious tactic worldwide for exactly what it is, so if these treacherous misfits try to do ANYTHING to Mumia, they will be exposed to the world for the spineless punk-ass cowards and weaklings that they are. MOVE and Mumia supporters ain’t never gonna stop!

Wir akzeptieren aber in keiner Weise die lebenslängliche Strafe, wo es gemäß der Staatsanwaltschaft auch keine Berufungsmöglichkeit mehr geben soll. Der Rückzieher der Staatsanwaltschaft zeigt nochmals, dass dem linken Journalisten Mumia Abu-Jamal 1982 aus politischen und rassistischen Gründen ein Mord angehängt wurde und unschuldig ist!

USA – Todesstrafe gegen Mumia Abu-Jamal endgültig verhindert
Freitag 30. Haftjahrestag – Freilassung gefordert
Berlin, den 07. Dezember 2011
Heute hat Philadelphias Bezirksstaatsanwalt Seth Williams bestätigt, was
eigentlich schon lange bekannt ist: die Todesstrafe gegen den
afroamerikanischen Journalisten Mumia Abu-Jamal ist verfassungswidrig.
Nun verzichtet der Ankläger endgültig darauf, weiter auf eine
Hinrichtung des seit 30 Jahren inhaftierten Menschenrechtsaktivisten zu
drängen.
Bereits vier mal hatten US-Bundesgerichte festgestellt, dass das
Todesurteil auf Rechtsbrüchen im ursprünglichen Verfahren von 1982
basiert. Zuletzt hat das der Oberste Gerichtshof der USA im Oktober 2011
klargestellt.
Die Menschenrechtsorganisation Amnesty International hat jedoch bereits
im Jahr 2000 festgestellt, dass das gesamte Verfahren „einen Bruch
internationaler Mindeststandards für die Sicherung fairer Verfahren“
darstelle und deshalb ein neues Verfahren gefordert.
Das Todesurteil ist nun endgültig vom Tisch – ein großer Sieg für
Abu-Jamal. Dennoch wird die Internationale Solidaritätsbewegung,
unterstützt von zahlreichen Personen des öffentlichen Lebens und
verschiedenen Länder- und Kommunalparlamenten, nun erst recht die
Freilassung des seit 3 Jahrzehnten inhaftierten Journalisten fordern.
In Philadelphias Constitution Center werden am kommenden Freitag aus
Anlass des 30. Haftjahrestages von Abu-Jamal Sprecher und Sprecherinnen
aus den gesamten USA die Stimme gegen die anhaltende Inhaftierung
erheben. Lebenslänglich ohne Entlassung im Gefängnis ist keine Alternative.
Begleitet wird der Jahrestag von Protesten und Veranstaltungen in
Mexiko, Kanada, Frankreich, Großbritanien, der Schweiz, Österreich und
der Bundesrepublik: z.B. am Samstag um 16 Uhr vor der Nürnberger
Lorenzkirche.
Die Verteidigung von Mumia Abu-Jamal ist im Frühjahr 2011 vom Legal
Defense Fund des National Association for the Advancement of Colored
People (NAACP-LDF) übernommen worden, die in dem Fall eines der
wichtigsten Bürgerrechtsverfahren in den USA erachten.

CENTER CITY – December 7, 2011 (WPVI) — There are new developments in the case of Mumia Abu Jamal.
Multiple reports suggest Philadelphia District Attorney Seth Williams will hold a press conference Wednesday about the future of the case.
Jamal was convicted of killing Philadelphia police officer Daniel Faulkner.
The murder was 30 years ago this Friday.
Jamal was sentenced to death, but that sentence was overturned after years of appeals.
That means the state needs to hold a new sentencing hearing.
District Attorney Williams has to decide whether to seek the death penalty again, or to allow Jamal to serve life in prison
